Terms of Service

These Terms of Service ("Terms") govern your use of the Ascend AI iOS application ("App") operated by Ascend AI ("we," "us," or "our"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you meet this requirement. If you are under 18, you represent that you have obtained parental or guardian consent.

2. Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@ascendyourself.com if you suspect unauthorized access. We reserve the right to terminate accounts that violate these Terms.

3. Subscription and Billing

The App offers an auto-renewing subscription ("Ascend AI Pro") that unlocks all features.

Free trial: New subscribers receive a 3-day free trial. Your payment method will be charged at the end of the trial period unless you cancel before it ends.
Pricing: $9.99 per month or $49.99 per year (prices may vary by region).
Billing: Payment is charged to your Apple ID at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
Managing your subscription: You can manage or cancel your subscription at any time through your Apple ID settings (Settings → Apple ID → Subscriptions).
No refunds: We do not offer refunds for partial subscription periods. Refund requests are handled by Apple in accordance with their refund policy.

4. Acceptable Use

You agree not to:

Use the App for any unlawful purpose
Upload photos of others without their consent
Attempt to reverse engineer, modify, or tamper with the App
Use automated tools to access or scrape the App
Impersonate any person or entity
Upload content that is illegal, harmful, or violates the rights of others

We reserve the right to suspend or terminate your account for violations of these Terms.

5. Photos and Content

By submitting a photo to the App, you grant us a limited, non-exclusive license to transmit and process that photo solely for the purpose of generating your analysis. Photos are processed by our AI provider (OpenAI) and are not permanently stored on our servers after analysis is complete. You retain all ownership rights to photos you submit.

You are responsible for ensuring you have the right to submit any photos you upload.

6. AI-Generated Content

The facial analyses, scores, and improvement recommendations generated by the App are produced by artificial intelligence and are for informational and entertainment purposes only. They do not constitute medical, dermatological, psychological, or professional advice of any kind.

The App is not a substitute for professional medical or mental health advice. Do not rely on the App's output for health-related decisions. Always consult a qualified professional for medical concerns.

7. Intellectual Property

All content, features, and functionality of the App — including text, graphics, logos, and software — are owned by us or our licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

8. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Account Deletion

You may delete your account at any time through Settings → Delete Account in the App. Deletion permanently removes all your data from our systems. Deleting your account does not automatically cancel your subscription — you must cancel your subscription separately through your Apple ID settings to avoid future charges.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date. Continued use of the App after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising out of or relating to these Terms or your use of the App shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you hereby consent to the personal jurisdiction and venue of such courts.
